Terms of Service

You must be at least 18 years old and capable of entering into a legally binding contract under Nigerian law. By using the Platform you represent that you meet these requirements.

We reserve the right to refuse or terminate access for any user who violates these Terms.

You are responsible for maintaining the confidentiality of your login credentials. You must provide accurate, current, and complete information at registration and keep it updated.

One person may not operate multiple accounts. Dealers found operating multiple accounts to circumvent listing limits will be permanently banned.

Eligibility: Only registered and verified dealers may post car listings. Verification requires government-issued ID and, for Premium and Elite tiers, CAC registration.

Accuracy: All listing details — price, condition, mileage, year, and photos — must be truthful. Misrepresenting a vehicle is grounds for immediate removal and potential legal action.

Listing expiry: Basic listings expire after 60 days, Premium after 90 days, Elite after 120 days. Expired listings are automatically removed from search.

Prohibited listings: Stolen vehicles, salvage vehicles presented as clean, vehicles with outstanding finance not disclosed, or any vehicle you do not have the right to sell are strictly prohibited.

When a buyer expresses interest through our platform, the following flow applies:

1. Buyer submits a ₦50,000 security deposit via Paystack.
2. BuyCar confirms availability with the dealer.
3. Upon confirmation, BuyCar releases the dealer's direct contact details to the buyer by email.
4. Buyer and dealer negotiate and complete the transaction directly.

The deposit is not a purchase. It is a security deposit held by BuyCar to filter serious buyers. Refund terms are in our Refund Policy.

Spare parts are sold by third-party dealers. BuyCar facilitates the transaction but does not hold inventory. Dealers are responsible for order fulfilment and product accuracy.

Buyers agree to our Refund Policy before placing an order.

Mechanics listed on BuyCar are independent contractors. BuyCar verifies their identity but is not a party to the service agreement between a mechanic and a buyer. BuyCar is not liable for the quality of mechanic services rendered.

You may not:

• Post false, misleading, or fraudulent listings
• Scrape or systematically extract data from the Platform without permission
• Use the Platform for money laundering or any unlawful financial activity
• Harass, threaten, or defraud other users
• Attempt to bypass our security, authentication, or listing limits
• Post content that is defamatory, obscene, or violates any law
• Reverse-engineer, copy, or create derivative works from our Platform

All content on the Platform — design, code, trademarks, and original text — is owned by BuyCar Technology Limited or licensed to us. Dealer-submitted photos and listing content remain the dealer's property, but by posting, the dealer grants BuyCar a worldwide, royalty-free licence to display, distribute, and promote that content on the Platform and in advertising.

BuyCar is a marketplace platform. We are not a party to transactions between buyers and dealers. To the fullest extent permitted by Nigerian law, BuyCar is not liable for:

• The accuracy of dealer listings
• Vehicle defects discovered after purchase
• Disputes between buyers and dealers
• Loss of profits, data, or goodwill arising from use of the Platform

Our aggregate liability is limited to the amount you paid us in the 3 months before the claim arose.

We may suspend or terminate your account with or without notice if you violate these Terms. You may delete your account at any time by contacting support@buycar.ng. Active subscriptions are non-refundable upon self-termination.

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration in Lagos under the Arbitration and Mediation Act 2023.

We may update these Terms from time to time. Material changes will be notified to registered users by email at least 7 days in advance. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
